These Terms and Conditions ("Terms") apply to all products and services offered on the Koomalooma website www.koomalooma.com ("Website").

Please read them carefully, as well as our Privacy Policy, before proceeding, as they set out the contractual agreement between you (the "User") and us ("Koomalooma" or "Company").

You acknowledge that you have read and agree to the Terms, as well as to the Privacy Policy, when using Koomalooma, such as, but not limited to, browsing the website, purchasing products, and registering a user account. If you do not agree with both these Terms and the Privacy Policy, you are not allowed to use Koomalooma services and you must leave this website immediately.

Terms and conditions

1. Introduction

1.0.1 These Terms, as may be amended from time to time, apply to all Koomalooma services directly or indirectly (through third party distributors) made available online, through any mobile device, by email, or by telephone.

1.0.2 By accessing, browsing, and using our website or any of our applications, and/or purchasing products or registering a user account, you acknowledge and agree to have read, understood, and agreed to the terms and conditions set out below including our Privacy Policy.

1.0.3 This website www.koomalooma.com including its pages, content, and infrastructure and the services provided by us on these pages and through the website, are owned, operated, and provided by Big Dream Ventures B.V., and are provided for your personal, non-commercial use only, subject to the terms and conditions set out below.

2. Definitions

2.0.1 Terms or expressions used in these terms and conditions are defined as follows, unless the context specifies otherwise:

'Accommodation Services Provider' means the provider of a hotel, home, accommodation, or other place of lodging.

'Additional Travel Services' means any ancillary services related to your booking that may be offered by Travel Service Providers (TSPs) or other third parties. These services can include, but are not limited to, upgrades, additional luggage, priority seating, meals, passenger information changes, rebooking, or cancellation.

'Airline Operator' means the airline providing the services of travel by air.

'Application Form' is defined as the electronic form containing personal identification data and other user information to be inserted by the User and submitted to the Company in order to register a user account.

'Booking' means the process of selecting and purchasing Travel Products, including but not limited to hotels, flights, or any combination thereof, through the Koomalooma platform. A Booking is considered complete when Koomalooma confirms receipt and acceptance of the customer's payment for the Total Price.

'Card Product' means any digital or physical prepaid card, gift card, or voucher that can be purchased through the Koomalooma platform. These cards are typically issued by various merchants, retailers, or financial institutions and are redeemable for goods, services, or cash value according to the terms and conditions set by the issuer.

'Company', 'Koomalooma', 'We', or 'Us' means Big Dream Ventures B.V. a limited liability company incorporated under the laws of The Netherlands, with registration number 63338149.

'Customer Care' is defined as any service unit fully authorized by the Company to provide a range of services to support users with any issue using the service, to receive feedback, complaints as well as ideas on how Koomalooma can improve its service.

'End User', 'User', or 'you', is defined as any web user accessing the Koomalooma website either directly or through third party distributors. An End User may also be a Registered User.

'Issuer' is defined as the creator, designer, issuer, organizer, beneficiary or manager of Card Products.

'Mobile Product' refers to any service or product related to mobile telecommunications that can be purchased through the Koomalooma platform. This includes, but is not limited to, the top-up of prepaid mobile credit, airtime, data bundles, and eSIMs.

'Partners' are third-party companies with whom Koomalooma has a direct contractual relationship. Partners include product suppliers, as well as technical service providers.

'Platform' means collectively the website www.koomalooma.com including its pages, content, and infrastructure and the services provided by the Company on these pages and through the website.

'Product' or 'Products' is defined as any product/s that can be purchased on the Koomalooma website.

'Product Catalogue' is defined as the entirety of Products made available to be purchased on the Koomalooma website.

'Registered User' is defined as an eligible User who has successfully completed the registration process, accepted the Terms and has been assigned a registration number after acceptance by the Company.

'Service' or 'Services' refers to the services offered by Koomalooma to the User for the purchase of Products on the Koomalooma website and in accordance with these Terms.

'Supplier' is defined as any company from which the Company procures Products made available in the Product Catalogue, to be sold to Users.

'Terms' is defined as the terms and conditions of this agreement which governs the relationship between the User and Koomalooma. Wherever it is not expressly specified, Terms includes the Privacy Policy.

'Total Price' means the total amount payable by the User for the purchase of Products on the Koomalooma platform. This amount includes the price of the selected products, any applicable taxes, fees, and additional charges. The Total Price is displayed to the User prior to the completion of the transaction and represents the final amount to be paid.

'Travel Document' means any physical or digital document provided to the User upon the purchase of Travel Products from our platform. These documents act as confirmation of the products and services purchased and are issued by the respective Travel Service Providers.

'Travel Product' means direct bookings for flights, hotel stays, vacation rentals, and various experiences such as tours and excursions made available on the Koomalooma Platform.

'Travel Service Provider' or 'TSP' means any third-party company or entity that offers travel-related products and services available for purchase through the Koomalooma platform. This includes, but is not limited to, Airline Operators, Accommodation Service Providers, and Activity Providers. Each TSP is responsible for delivering the specific products or services purchased by the User.

'User Account' or 'Account' is defined as a record associated with a unique identifier associated to a Registered User and containing various information collected during registration or subsequently modified by the Registered User, as well as transaction history.

3. The service

3.0.1 Koomalooma offers an e-commerce platform specialised in the resale of various Products, including Card Products, Mobile Products and Travel Products that can be purchased by the User using everyday payment methods.

3.0.2 The Product Catalogue is organised on the Platform to show the available products that can be purchased in a specific country or region.

3.0.3 For Card Products and Mobile Products, the User can select the Product(s) they intend to purchase by choosing the brand of the Issuer and selecting the amount in local currency. The amount can be either (i) selected from a list of predetermined amounts or (ii) freely defined by the User, subject to any minimum or maximum limits set by the Issuer.

3.0.4 For Travel Products, the User can browse and select specific travel-related services, such as flights, hotel stays, or activities. Travel Products are offered and priced based on availability at the time of booking.

3.0.5 The User pays for the Product(s) using a payment method accepted by Koomalooma and displayed at checkout, within the time allowed to complete the payment.

3.0.6 In order for the payment to be valid, the User must complete the full payment within the time limit displayed on the payment page.

3.0.7 Depending on the Product, the User may redeem the Product immediately with the relevant Issuer through Koomalooma, in which case a written notification of redemption will be provided, or receive it onscreen and/or by email or SMS, to be redeemed independently at a later stage.

3.0.8 Card Products are provided to the User in the form of a numeric or alphanumeric code, a QR code, or a hyperlink to a third-party website. These codes are delivered to the User via email and/or displayed in the User's Account section of the Platform.

3.0.9 For Mobile Products, Users must provide the exact mobile phone number (MSISDN) to which they want the mobile credit to be applied. The mobile product is delivered either Over-The-Air (OTA) or via a code sent by email.

3.0.10 Mobile Products are only available for prepaid mobile subscriptions. It is not possible to top up post-paid plans using these products. Purchasing a Mobile Product for a post-paid plan may result in a non-refundable transaction.

3.0.11 Travel products are delivered to the User by email and/or through a dedicated interface in the User Account in the form of Travel Documents containing details such as itineraries and booking references.

3.0.12 All Travel Products are subject to the terms and conditions of the relevant Travel Service Providers. Please read and understand these terms before placing your booking. By completing the booking, you confirm acceptance of the terms and conditions for all travelers.

3.0.13 Travel Documents are non-transferable. When booking a Travel Product, the Travel Document must be issued in the name of the passport or photo identity of the holder. Please ensure that all details on your booking are accurate.

3.0.14 When you purchase a flight or lodging through Koomalooma, Koomalooma acts solely as an intermediary (a disclosed booking agent) between you and the named travel provider. The transport or accommodation contract is concluded directly between you and that provider and is governed by the provider's own terms and conditions. Koomalooma is not a party to, nor responsible for, the performance of the travel service.

3.1 Business to consumer

3.1.1 The Koomalooma service is provided to the User for personal, non-commercial (B2C) use only. If a business wishes to purchase products from Koomalooma it must first enter into a separate B2B agreement with Koomalooma.

3.1.2 Products purchased through Koomalooma may not be re-sold and shall be redeemed only either by the User, on the User's behalf or by someone to whom the User has gifted the product.

3.2 Product availability and refunds policy

3.2.1 Koomalooma provides its services through a network of third-party service providers.

3.2.2 Transactions may, from time to time, fail due to technical or other reasons. The User acknowledges and agrees that Koomalooma may not be liable for a technical issue that affects its transaction. Whenever a transaction fails due to technical reasons, a User may qualify for a refund.

3.2.3 The Company will consider a transaction failed if it has received the correct User details and the correct payment amount and one of these cases occurs: (a) the User did not receive the Product; or (b) the Product was correctly delivered to the User but cannot be utilised. Upon being contacted by the User, Koomalooma will investigate the issue. Once the appropriate investigation is made, and Koomalooma deems there is no fraud or foul play by the User, the User will be eligible for a refund.

3.2.4 Koomalooma will not refund Users if: (a) the User does not comply with the Terms or other policies of the Issuer in relation to redeeming the Product; (b) the User provided wrong contact or delivery information resulting in the Product being delivered to the wrong recipient; (c) disputes relating to the travel service itself must be directed to the travel provider; or (d) the User violated these Terms.

3.2.5 Determining if the User has the right to a refund can be complicated and can take time. While most refunds are completed within 2 business days, Koomalooma reserves the right to a 2-week period from the date the issue occurred to investigate and decide whether to apply the refund.

3.2.6 Refunds are made by Koomalooma via the original payment method used by the User, where technically possible, or by an alternative method agreed with Customer Care. The Customer Care may offer the User the possibility to receive the product initially requested or an alternative product instead of the refund.

3.2.7 Refunds must be requested within 30 days from the date of the transaction. For refund requests, the User shall contact support@koomalooma.com.

3.2.8 Once a Product is received, no refunds or reimbursements will be offered.

3.2.9 Any attempt by users to obtain products or refunds in a fraudulent manner is considered a criminal offence, and as such will be communicated to the relevant authorities.

3.3 Bookings, cancellations and changes

3.3.1 The cancellation and change policy applicable to each Travel Product (excluding flights) is displayed before the User completes the online booking. The User should read the change and cancellation policy for the selected Travel Product carefully, as these policies vary between Travel Service Providers. Any flight booking cancellations and/or changes are subject to the specific terms and policies of the Travel Service Provider.

3.3.2 Voluntary changes to flight bookings can only be requested up to 72 hours before departure. If the User voluntarily cancels or makes changes to the booking, the Travel Service Provider may charge a cancellation or change fee. If the User arrives late, leaves early, or fails to arrive (no-show), Koomalooma will not issue any refunds.

3.3.3 If the User's booking is cancelled or altered by the Travel Service Provider, Koomalooma will do its best to inform the User as soon as possible. Koomalooma is not liable for any consequences resulting from cancellations or changes made by these third parties.

3.4 User accounts

3.4.1 Koomalooma offers the possibility for eligible users to register a user account. A User may only submit one application form and may have only one user account. The user account must be in the Registered User's legal name and must be associated to a valid email address. The User guarantees the correctness of all information given.

3.4.2 In case of duplicate accounts, the Company reserves the right to cancel one or both accounts and cancel any associated benefits.

3.4.3 The user account cannot under any circumstances be transferred, assigned, sold or combined with the account of any other person.

3.4.4 The Registered User is responsible for the usage of their password and shall not disclose the password to any third party.

3.4.5 All users registering an account on Koomalooma shall be deemed to have read and accepted these Terms as well as the Privacy Policy.

3.5 Customer care

3.5.1 To resolve an issue when using the Koomalooma service, the User must get in touch with Customer Care through the appropriate channels:

a. Completing the online contact form at www.koomalooma.com/contact-us

b. Sending an email to: support@koomalooma.com

3.5.2 If contacted through the appropriate channel, Customer Care will do its best to provide a first reply within 24 hours, but it may take longer depending on the issue and the total number of requests being processed.

3.6 Third-party payment methods

Koomalooma may offer Users multiple payment methods, including payments processed directly by Koomalooma and payments facilitated through third-party payment providers or gateways.

Third-party payment methods are operated by independent third parties and are subject to their own terms and conditions. Koomalooma does not control, operate, or guarantee the availability, performance, security, or compliance of any third-party payment provider.

Koomalooma is not responsible for delays, failures, reversals, or losses arising from the use of third-party payment methods. Once a payment is completed and confirmed in accordance with the rules of the selected payment method, the transaction is final.

Users are solely responsible for understanding and accepting the terms, conditions, and risks applicable to any third-party payment method they choose to use. Koomalooma disclaims any liability arising from a User's use of third-party payment providers.

4. Limitations of use

4.0.1 In accordance with the Company's compliance policies, we may request certain information from the User and limit the amounts that Users can spend on Products within specific time frames. Applicable limits are displayed at checkout and may vary by product category, user verification level, and applicable regulations.

4.0.2 Any User creating or using more than one Koomalooma account, or any other means to circumvent spending limits, is in breach of these Terms and may result in Koomalooma suspending the account(s). Where required by applicable laws and regulations, any illegal circumvention of spending limits may be reported to the relevant authorities.

5. Intellectual property

5.0.1 The design, service, content, texts, logos (including the Koomalooma logo, the word Koomalooma) and any proprietary software and technology developed by Koomalooma is the exclusive property of Koomalooma, and is protected by copyrights, trademarks, service marks, international treaties, and/or other intellectual proprietary rights and laws of the Netherlands and other countries.

5.0.2 These Terms grant the User no right, title, or interest in any intellectual property owned or licensed by Koomalooma, including but not limited to, the Platform, Service and Koomalooma trademarks.

5.0.3 Logos and trademarks used to identify third-party products are the property of the respective Issuers and/or other third parties. Such logos and trademarks are used to identify the product and/or its Issuer. Koomalooma does not claim any ownership, license, authorisation, partnership or agreement with the owners of such logos or trademarks.

6. Disclaimers

6.0.1 Koomalooma has concluded agreements with wholesalers to purchase Products from Suppliers in its own name. Koomalooma sells the Products in its own name to its Users. As such, Koomalooma is a reseller of the Product.

6.0.2 Unless otherwise expressly mentioned, Koomalooma is not sponsored by any Issuer, nor are we related to, acting on behalf of, or under express authorisation of any Issuer.

6.0.3 The relevant Travel Service Provider is responsible for providing the Travel Service to the User. Koomalooma is not responsible for the provision of Travel Services or the terms upon which they are offered. Koomalooma is also not responsible for any default, defect, delay, or failure in any supply of Travel Services by any TSP.

6.0.4 Koomalooma accepts no liability for any delay, cancellation, schedule change, over-booking, force-majeure event or other non-performance of the travel service itself; such matters remain the sole responsibility of the relevant airline, accommodation or other provider.

6.0.5 Before making a card purchase on Koomalooma, the User is required to engage in adequate due diligence of the terms and conditions of the Card Product being acquired. Koomalooma will not accept or be liable for any claims in relation thereto.

6.0.6 Koomalooma makes no representation regarding the Product's suitability for its intended use and makes no other guarantees, warranties or representations in respect of the Product.

6.1 Responsibility of the user

6.1.1 The User is fully liable for any mistakes, losses or damages (against themselves, us, or any third-party) arising from (i) the provision of incorrect, inaccurate or fake information and from (ii) the acquisition, resale, use or other related activities of the Product in a manner that infringes any applicable laws, regulations, or contractual terms.

6.1.2 The User is solely responsible for the accuracy and correctness of the information provided (including, but not limited to, email address, phone number, country, network operator, the amount of the top-up, and any details required for Travel Products). Koomalooma shall not be liable for any consequences arising from the inaccuracy of the information provided by the User.

6.1.3 A Registered User is responsible for maintaining the confidentiality of their password and account and for any activities and transactions that occur under their account.

6.2 Unlawful use

6.2.1 The Koomalooma services, Platform and any Products purchased from Koomalooma shall not be used, in any way, to infringe or circumvent applicable laws and regulations.

6.2.2 Koomalooma will restrict User access, terminate Registered User accounts and communicate to the relevant authorities any User activities should Koomalooma become aware, or reasonably suspect, that a User is conducting unlawful activities or otherwise breaking applicable laws and regulations or third-party rights.

6.2.3 Those who choose to access Koomalooma do so on their own initiative and are responsible for compliance with all local laws and regulations. If it is illegal or prohibited in the User's country of origin to access or use Koomalooma, or to buy or use any of the Products, then the User shall not do so.

6.3 Limitation of liability

6.3.1 Koomalooma shall in no event be responsible or liable to the User, Issuers or any third party, whether in contract, warranty, tort (including negligence) or otherwise, for any loss or damage arising out of or related to the Service or Platform, including but not limited to, special, incidental, exemplary, punitive, direct, indirect or consequential damages, damages for any loss of profit or revenue, injury to person or property, business interruption, or loss of business or personal information, even if Koomalooma is advised of the possibility of such damages. Such limitation shall apply to the fullest extent permitted by law.

6.3.2 In jurisdictions that limit the ability to disclaim liability, Koomalooma' liability shall be limited to the greatest extent permitted by applicable law.

6.3.3 No members of the Koomalooma team (including employees, contractors, directors, management members and other collaborators) shall have any liability in relation to the use of, or reliance upon, Koomalooma or the Products purchased by Users.

6.3.4 Koomalooma accepts no responsibility whatsoever for viruses, malware or other malicious or damaging software on User's devices.

6.3.5 The Koomalooma website may include links to third-party websites. Koomalooma has no control over these third parties or over the content, products, services and technologies they offer, and therefore does not accept any responsibility whatsoever for third-party sites available through Koomalooma via hyperlink.

7. Personal data protection and privacy

7.0.1 Our Privacy Policy defines how Koomalooma collects, processes, accesses, stores and deletes User data.

7.0.2 The User shall visit and review our Privacy Policy and shall not proceed with using Koomalooma if the User does not agree and consent with it. Users are required to accept the Privacy Policy when applying for a Registered Account.

8. Miscellaneous

8.1 Amendments to the terms

8.1.1 Koomalooma reserves the right to amend these Terms at any point, without any obligation of prior and/or public notice. As such, Users shall refer to the present page before browsing the Koomalooma website and before completing any purchase.

8.2 Jurisdiction

8.2.1 These Terms shall be governed by and construed in accordance with the laws of the Netherlands. The User agrees to submit to the jurisdiction of the Netherlands courts to settle any disputes arising in connection with these Terms.

8.3 Enforceability

8.3.1 In the event any provision of these Terms is determined to be invalid or unenforceable, such provision shall be deemed severed from the remainder of these Terms and replaced with a valid and enforceable provision as similar in intent as reasonably possible, and shall not cause the invalidity or unenforceability of the remainder of these Terms.

8.4 Entire agreement

8.4.1 These Terms, together with the Privacy Policy, set forth the entire agreement between the User and Koomalooma with respect to the subject matter hereof and supersede all prior agreements relating to such subject matter.
